Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, in the nature of writ , directing the respondents to consider the petitioner for appointment on the basis of compassionate ground.

O R D E R

The present Review application has been preferred on the ground that when the writ petition was taken up for final hearing on 07.02.2018, the learned counsel for the writ petitioner was not aware of the fact that the petitioner was already appointed into the Government service on 05.04.2013. The writ petitioner had not informed the learned counsel for the petitioner about this fact. Thus, the learned counsel for the petitioner was unable to submit before this Court that the writ petitioner had already been appointed in Government service.

2.At the out set, the present review petition has been filed on account of the fact that the writ petitioner was appointed in Government service during the pendency of the writ petition and this https://hcservices.ecourts.gov.in/hcservices/

fact was not informed to the learned counsel for the petitioner at the time of taking up the writ petition for final hearing. Thus, the writ petitioner is constrained to move the present review petition. 3.Though the fact relating to the appointment of the writ petitioner was available, the same was not properly informed to the learned counsel appearing on behalf of the petitioner. Thus, this Court is inclined to consider the present review application submitted by this writ petitioner.

4.Accordingly, the order passed in W.P(MD)No.9420 of 2012, dated 07.02.2018 is recalled and the writ petition stands closed. 5.In view of the above, the review application stands disposed of.
