O R D E R

This petition has been filed to direct the respondent to register a case, based upon the complaint given by the petitioner dated 03.11.2017.

2. The learned counsel appearing for the petitioner has submitted that the proposed accused criminally intimidated the petitioner and also abused him in filthy language and hence, a complaint was lodged before the respondent on 03.11.2017, but, so far, no action has been taken.

3. The learned Government Advocate (Crl. Side) appearing for the respondent has submitted that already a civil suit is pending in O.S.No.328 of 2010, on the file of the Sub Court, Srivilliputur, for declaration and recovery of possession, between the parties and hence, after enquiry, the complaint was closed directing the parties to get remedy before the Civil Court.

4. The learned counsel appearing for the petitioner by way of reply has submitted that the petitioner has not received any information from the respondent, with regard to the closing of his complaint.

5. Considering the aforesaid submissions, the respondent is directed to inform the petitioner, with regard to the closing of his complaint by Registered Post and it is open to the petitioner to seek any other remedy which is available under the law.

6. With the above observation, the Criminal Original Petition is disposed of.
