ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody since 15.01.2019 for the offences punishable under Sections 341, 397 and 506(ii) of IPC, in Crime No.21 of 2019, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that when the defacto complainant coming near Asanathpuram, Dindigul, the petitioner along with another accused way laid the defacto complainant and threatened with knife point and took away Rs.300/- from the defacto complainant. Hence, the complaint.
3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor would submit that the the petitioner is A1 in this case and he is having six previous cases and he is also a history sheeted rowdy. Moreover, the petitioner's earlier bail application was dismissed by this Court and now no change of circumstances in this case. Hence, he prayed for dismissal of the application.
5.Considering the facts and circumstances of the case and since https://hcservices.ecourts.gov.in/hcservices/
the petitioner is having six previous cases against him and since he is a history sheeted rowdy and since now there is no change of circumstances, this Court is not inclined to grant bail to the petitioner.
6.Accordingly, this Criminal original petition stands dismissed.
