PRAYER :- For Bail in Crime No. 356/2021 on the file of the Respondent Police.
ORDER : The Court made the following order :- The petitioner/Accused No.3 herein, who was arrested on 05.12.2021 for the alleged offence under Sections 294(b), 353, 506(ii) of IPC and Section 25(1B) (a) Arms Act 1959 and Section 3(1) TN Public Property (Prevention of Damage and Loss) Act, 1992 in Crime No.356 of 2021, on the file of the respondent police, seeks bail.
2.The case of the prosecution is that on when the police party was on routine inspection on suspicion, the accused persons were taken to the police station and at that time A1 took aruval from the petitioner's bag and tried to assault the respondent police. The accused persons scolded the respondent police in filthy language and threatened him with dire consequences. Hence, the case. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution. The co accused in this case has been released on bail by this Court in Crl.O.P.(MD).No.20748 of 2021 by an elaborate order. The petitioner was arrested and remanded into judicial custody from 05.12.2021.

CRL OP(MD). No.1746 of 2022 5.Considering the period of incarceration and the fact that the co-accused has been released on bail by this Court, this Court is inclined to grant bail to the petitioner with certain conditions. 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvaiyaru, and on further condition that the petitioner shall report before the respondent police once in fifteen days at 10.30 a.m. until further orders. sd/- 31/01/2022 / TRUE COPY / 31/01/2022 Sub-Assistant Registrar (C.S.)
