Prayer : Petition filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order passed by the first respondent vide proceedings in No.1250/Utha.2/2025, dated 11.12.2025 and quash the same as illegal and consequently direct the first respondent to grant 21 days ordinary leave without escort police to the petitioner's husband namely Nataraj S/o. Shanmugam, aged about 63 years, Life Convict Prisoner, PID No.363874 confined at Central Prison, Madurai. O R D E R

[Order of the Court was made by N.ANAND VENKATESH, J.] This Writ Petition has been filed challenging the proceedings of the first respondent dated 11.12.2025, wherein, the first respondent granted 21 days ordinary leave with escort to the petitioner's husband, who is a life convict, confined at the Central Prison, Madurai.

2. Heard Mr.Suresh, learned counsel appearing for the petitioner and Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor appearing for the respondents.

3. On an earlier occasion, the petitioner filed a writ petition before this Court in W.P.Crl.(MD).No.2339 of 2025 seeking for a direction to the second respondent to grant ordinary leave. When the writ petition was pending, the second respondent through proceedings dated 22.12.2025 granted 21 days ordinary leave with a condition to the petitioner's husband to report before the Inspector of Police, Aruppukkottai Police Station.

4. When the writ petition came up for hearing on 06.01.2026, this Court was informed about the proceedings of the second respondent dated 22.12.2025. The learned counsel appearing for the petitioner informed this Court that the petitioner's husband was undergoing treatment at Meenakshi Mission Hospital, Madurai and therefore, he will not be able to report before the Aruppukkottai Police Station.

5. Considering the same, this Court disposed of the writ petition by directing the petitioner's husband to report before the Inspector of Police, Othakadai Police Station, Madurai.

6. After the above order was passed, the first respondent has issued the impugned proceedings dated 11.12.2025 granting 21 days ordinary leave with escort. Aggrieved by the condition imposed by the first respondent, the present writ petition has been filed before this Court.

7. In our considered view, the petitioner's husband has taken treatment at Meenakshi Mission Hospital, Madurai. Therefore, it will be more appropriate if the petitioner's husband is directed to report before the Inspector of Police, Othakadai Police Station, Madurai, daily at 05.30 p.m. We are inclined to interfere with the condition imposed by the first respondent directing an escort to accompany the petitioner's husband, and the same is hereby set aside.

8. In the result, the impugned proceedings of the first respondent dated 11.12.2025 is modified by setting aside the condition regarding the

escort accompanying the petitioner's husband and the same is modified to the effect that the petitioner's husband will report before the Inspector of Police, Othakadai, Madurai, everyday at 05.30 p.m., during the entire ordinary leave period. The other conditions imposed by the first respondent shall stand as it is.

9. This Writ Petition (Criminal) is disposed of with the above directions.
