ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehends arrest at the hands of the respondent Police for the alleged offences punishable under Sections 468 and 471 IPC r/w Section 12(1)(b) of the Passport Act in Crime No.673 of 2015 on the file of the respondent Police and hence, seeks anticipatory bail.

2.According to the prosecution, the accused has produced fake birth certificate before the passport authorities to obtain passport. 3.The learned counsel for the petitioner submitted that the petitioner is an engineering graduate and his father approached one broker for obtaining passport and also produced certificates to him and some mistake was committed by the agent. He further submitted that the de facto complainant has not issued passport to the petitioner so far. 4.The learned Government Advocate (Crl.side) appearing for the respondent Police submitted that the petitioner has no bad antecedent and at the stage of processing the application, the de facto complainant found that the birth certificate produced by the petitioner is a fake one.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner, with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Dindigul, and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required.
