The learned counsel appearing for the petitioner seeks permission of this Court to withdraw this petition with liberty to prove the genuineness that the signature in the concerned cheque by resorting Section 73 of the Indian Evidence Act from available evidence and he opted to withdraw this petition. He has made an endorsement to that effect.
2. In view of the endorsement made by the learned counsel appearing for the petitioner, this criminal original petition is dismissed as withdrawn. Consequently, connected Miscellaneous Petition is closed.
