RESPONDENTS/RESPONDENTS Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased tocondone the delay of 2098 days in filing the above CMA(MD) SR.No.34261 of 2016 against the Judgment and Decree dated 13.08.2010 in MCOP No.634 of 2009, on the file of the Motar Accident Claims Tribunal cum Additional District and Sessions Judge/Fast Track Court, Dindigul.

ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S. M.PRAKASH, Advocate for the petitioner and the court made the following order:- This Petition is filed to condone the delay of 2098 days in filing the above appeal.

2.Heard the learned counsel for the Petitioner and perused the affidavit filed in support of the Petition and also the judgement of the court below.

3.On perusal of the affidavit filed in support of the Petition, this Court is not satisfied with the reasons furnished by the Petitioner in explaining the inordinate delay of 2098 days in filing the above appeal. On merits of the appeal also, the claimants have filed the claim petition claiming a sum of Rs.3 lakhs towards compensation, for the death of their father Gurusamy. Considering the facts and circumstances of the case and on appreciation of https://hcservices.ecourts.gov.in/hcservices/

evidence, the Tribunal has awarded a sum of Rs.2,79,000/- in favour of the claimants. The Petitioner/Appellant/Transport Corporation has filed the present appeal disputing the quantum of compensation and also the interest awarded by the Tribunal. 4.This Court, being not satisfied with the explanation furnished by the Petitioner for condonation of huge delay of 2098 days in filing the above appeal and also finding no merits in the main appeal, this Court is not inclined to entertain this application.
