After submitting representation dated 21.08.2023 seeking reconveyance of the land in Survey Nos.327/4B, 142/1C and 321/4 at Pattinamkathan village, Ramanathapuram Taluk, the present writ petition has been filed.

2. Learned counsel for the petitioner submits that the abovementioned lands have not been put to use after acquisition thereof. Therefore, he states that a representation was made by relying on Section 48B of the Land Acquisition Act, 1894.

3. Learned Government Advocate relies on the counter-affidavit filed by the Revenue Divisional Officer. He refutes the contention that the land was not put to use by referring to paragraph 14 of the counteraffidavit wherein it is stated that government offices are situated within the acquired land. He also refers to paragraphs 8 to 11 with regard to the deposit of the compensation amount, including enhanced compensation. Without prejudice, he submits that orders would be passed on merits on the petitioner's request for re-conveyance.

In the above facts and circumstances, without making any observations on the merits, this writ petition is disposed of by directing the second respondent to pass orders on the petitioner's representation dated 21.08.2023 on merits within three months from the date of receipt of a copy of this order.
