PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents 1 and 2 to produce the body or person of the detenue / petitioner's wife by name Kousalya, D/o.Murugan aged about 18 years before this Court and set her at liberty. ORDER

(Order of the Court was made by R.SURESH KUMAR, J.) The petitioner, seeking production of his wife, namely, Kousalya, D/o.Murugan, aged about 18 years, has filed this Habeas Corpus Petition. 2.When this Habeas Corpus Petition, after notice, is taken up for hearing, Mr.A.Thiruvadi Kumar, learned Additional Public Prosecutor appearing for the respondents submitted that the detenue has been secured and produced before this Court.

3.We enquire the detenue, namely, Kousalya, who would submit that her date of birth is 13.01.2005 and she become major on 12.01.2023. She would further submit that on 19.01.2023, the detenue married the petitioner herein and knowing the same, the parents of the detenue had taken the detenue to their home, from where she again left and now, she wants to join with the petitioner, who is the husband of the detenue. 4.The petitioner, namely, Ranjithkumar, has also present before this Court and he has submitted that he married the detenue on 19.01.2023 2/4

at Angalaparameshwari Amman Temple, Paramakudi, Ramanathapuram District in the presence of his mother, namely, Shanthi and the petitioner further submitted that he has been working as Electrician and he is earning enough to run the family with the detenue. He has also assured before this Court that he will take the detenue and live with her. 5.The aforesaid statements made by the petitioner as well as the detenue are hereby recorded. As the detenue become major and married the petitioner, this Court feels that the detenue can live with the petitioner and if there is any life threat as stated by the learned counsel appearing for the petitioner, they can approach the jurisdictional police concerned seeking for protection and it shall be considered by the jurisdictional police concerned on merits and in accordance with law.

6.With the above observations, this Habeas Corpus Petition stands closed.
