ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1, in Crime No.246 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 03.08.2015 for the alleged offences punishable under Section 304(b) of I.P.C., and hence, seeks bail.
2.According to the prosecution that the deceased, who is the wife of the petitioner/A1 had committed suicide due to dowry harassment of the accused.
3.The learned counsel for the petitioner submitted that the the petitioner married the deceased about 3 years before the occurrence and they were living happily. Whileso, she had developed illicit intimacy with her driver viz., Santhosh and they were seen in a compromising position by the petitioner and when it was questioned, she committed suicide. It is further submitted that after registration of the case, the driver of the petitioner/paramour of the deceased also committed suicide on 16.08.2015. The learned counsel also produced the death certificate of the said Santhosh.
4.The learned Government Advocate (Crl.side) would submit that the case was registered only on 02.08.2015 and the investigation is not yet completed.
5.However, considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail on the following conditions.
6.Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/-(Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Palani, Dindigul District and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m., until further orders.
