PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the first respondent to issue a passport to the Petitioner based on his application No.TR1067193773924 dated 09.12.2024 within the time stipulated by this Court.

ORDER

The present writ petition has been filed seeking a mandamus directing the first respondent to issue the passport to the writ petitioner based upon his application dated 09.12.2024.

2. The learned Government Advocate(crl.side) appearing for the second respondent brought to the notice of the Court that the petitioner has been implicated in a criminal case in Cr.No.19 of 2019 on the file of the second respondent police which has culminated in filing of a charge sheet on 31.01.2019 before the learned Judicial Magistrate, Pattukottai. Due to memo of objections raised by the concerned trial Court, so far the charge sheet has not been taken on file.

3. According to the learned Government Advocate(crl.side) appearing for the second respondent, it has been presented again on 30.01.2026.

4. Considering the fact that so far the trial Court has not taken cognizance for the past six years, there is no legal impediment whatsoever for the first respondent to consider the request of the petitioner for issuance of the passport. 2/4

The first respondent is directed to consider the request of the writ petitioner for issuance of the passport and pass orders within a period of 4(four) weeks from the date of receipt of a copy of this order.

5. With the above said observations, this writ petition stands disposed of. No costs.
