ORDER
This petition has been filed to issue a direction to the Judicial Magistrate, Kamudhi to speed up the trial in C.C.No.165 of 2018 in the interest of justice.
2.The learned counsel for the petitioner would submit that initially, the petitioner made a complaint before the respondent police. Since, there was no action taken, the petitioner approached the 4th respondent by way of a petition under RTI Act, wherein the petitioner was asked to approach the police department for his grievance. Hence, the petitioner again lodged a complaint before the Superintendent of Police and the Inspector of Police through post and in person. Again, there was no response to the complaint lodged by the petitioner. Hence, the petitioner filed a complaint under Section 156(3) Cr.P.C before the learned Judicial Magistrate, https://hcservices.ecourts.gov.in/hcservices/
Kamudhi. Though, the complaint was taken on file and assigned number as C.C.No.165 of 2018, no progress was made till now. Hence, this petition to issue a direction to the learned Magistrate to speed up the trial and pass orders.
3.The learned Additional Public Prosecutor appearing for the state has no objection to issue direction to the learned Judicial Magistrate.
4.Therefore, without expressing any opinion on merits, this Court directs the learned Judicial Magistrate, Kamudhi, to expedite the trial in C.C.No.165 of 2018 and pass appropriate orders in accordance with law within a period of three weeks from the date of receipt of a copy of this order.
