RESPONDENT/COMPLAINANT For Petitioner : M/S K.GOKUL Advocate For Respondent : M/s.S.PRABHA, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A2 apprehends arrest at the hands of the respondent police for the alleged offences punishable under sections 406 and 420 of IPC, in Crime No.682 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.According to the de-facto complainant the Regional Manager of State Bank of India that A1, who was working as Cash Officer in the State Bank of India, Melur Branch and the petitioner/A2, who is functioning as Appraiser of the Bank have pledged fake jewels as if it was pledged by the customers and received loan and caused loss to Rs.13,80,571/-. 3.

The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. The learned counsel further submitted that after registration of the case, A1 had repaid the entire alleged misappropriation amount of Rs.13,80,571/- and subsequently, he has also placed under suspension. It is further submitted that A1 was already released on anticipatory bail by this court in Crl.O.P.(MD)No.17695 of 2015, dated 23.09.2015. 5.Heard the learned Government Advocate (Criminal side) appearing for the respondent.

6.Considering the facts and circumstances of the case and also considering the fact that A1 was enlarged on anticipatory bail, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

7.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Melur and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police daily at 10.00 a.m until further orders.
