Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, forbearing the 6th respondent from encroaching upon or putting up any permanent or temporary structure and from in any manner obstructing, narrowing, diverting, covering or interfering with the free and continuous flow of water through the Ramachandrakulam Vari (water channel) and Kumankulam Road situated in Survey No.30/1C, Alangudi Taluk, Pudukkottai District, and from causing any obstruction whatsoever to the free and natural flow of water through the said water channel, and consequently direct the respondents 1 to 5 to ensure removal of any such encroachments, to restore the said Vari and road to its original condition and to maintain the same for free and unhindered use by the general public, by considering the petitioner's representation dated 01.01.2026 within a time frame to be fixed by this Court.

ORDER
Heard the learned counsel appearing for the writ petitioner, the Special Government Pleader appearing for the respondents 1, 2, 3 & 5 and the learned Government Advocate appearing for the fourth respondent. Considering the nature of relief to be granted, issuance of notice to the sixth respondent is dispensed with.
2.Though Survey No.30/1C is said to be a patta land belonging to the sixth respondent, it is stated that a geological stream passes through the said patta land. It is undertaken by the official respondents that the geological stream will be maintained as such and that, if there are any encroachments, the same will be removed. We make it clear that before resorting to any such measure, the sixth respondent will be duly put on notice. 3.The third respondent shall look into the writ petitioner's representation and inform the petitioner about the outcome. This exercise shall be done by the third respondent within a period of three months from the date of receipt of a copy of this order.
