ORDER

Seeking to direct the respondents 1 and 2 to provide police protection for the life and limb of the petitioner concerned, their labourers based on their representation dated 13.01.2026, this criminal original petition is filed.

2. Notice to the respondents 3 and 4 is dispensed with, since no adverse order is passed against the respondents 3 and 4.

The learned counsel for the petitioner submitted that he is a promoter, who promoted the lands comprised in S.No.103, 105, 108, 93, 106, 104, 94, 115, 117, 125, 124 measuring 45 Acres in Arasanur Village, Sivagangai. In this regard, he had entered into a memorandum of undertaking with the 3rd respondent to promote the said land and he had invested as much as Rs.3 Crores. Now, having promoted the said land, the 3rd respondent is trying to dispossess him. In this regard, he 2/6

has made a representation to the 2nd respondent police and the inaction of the 2nd respondent police has compelled him to come before this court.

4. The learned Government Advocate(Crl.Side) pointed out that the representation itself has been sent only on 13.01.2026 and within a period of just two weeks, he has come before this Court.

5. Heard the learned counsels on either side and carefully perused the materials available on record.

6. It is needless to point out that whenever a representation of this nature is made to a Statutory Authority, there is a duty cast upon the respondent to consider the same on its own merits and pass appropriate orders in one way or other instead of keeping the same pending indefinitely. As such, non-consideration of the representation made by the Statutory Authority would amount to dereliction of duty and hence, 3/6

this Court will be justified in invoking the inherent powers under Section 482 Cr.P.C/528 BNSS, 2023.

7. In view of the above, this Court directs the respondent police to consider the representation of the petitioner, dated 13.01.2026 and pass orders within a period of four (4) weeks from the date of receipt of a copy of this order.

8. With the above directions, this Criminal Original Petition stands disposed of.
