PRAYER: Petition filed under Section 482 of the Code of Criminal Procedure, to direct the first respondent to provide police protection to the petitioner to construct a bridge in S.No.139 of Melakandani Village, Keelakandani Group, Sivaganga Taluk, Sivaganga District.

ORDER

The present petition is filed by the petitioner to provide adequate police protection to the petitioner for construction of a bridge in S.No.139 of Melakandani Village, Keelakandani Group, Sivaganga Taluk, Sivaganga District.

2.The main grievance of Mr.V.S.Kumaraguru, learned counsel for the petitioner is that though the petitioner obtained permission to construct a bridge in S.No.139 of Melakandani Village, Keelakandani Group, Sivaganga Taluk, Sivaganga District, the first respondent did not provide adequate police protection to the petitioner. 3.Mr.A.Robinson, learned Government Advocate (Criminal side), who accepts notice on behalf of the first respondent, on instructions, would contend that since the orders dated 01.12.2020 was passed by the Block Development Officer granting permission to the petitioner to construct a bridge with certain conditions. 4.In the circumstances, the petitioner is directed to once again file a fresh representation before the first respondent and on receipt of the same, the first respondent shall pass appropriate orders, based on merits and on findings, and in accordance with law, within a period of two weeks from the date of receipt of the representation.
