ORDER : The Court Made the following order :- The Petitioner, who is arrayed as accused No.1, in Crime No.679 of 2015 on the file of the respondent police, was arrested on 02.09.2015 for the alleged offences punishable under Sections 147, 148, 448, 294(b),342, 506(ii) of I.P.C., r/w.Section 4 of Women Harassment Act and hence, seeks bail.
2. According to the de-facto complainant viz., Selvi Selvaraj that when she was working in the Church along with other women staff, the accused had trespassed into the church and scolded them in filthy language and pushed the women staff.
3. The learned counsel for the petitioner submitted that with regard to management of the Church, there are two groups and number of litigations are pending before the Court and the petitioner has been falsely implicated in this case.
4. The learned Government Advocate(Crl.side) vehemently opposed granting of bail to the petitioner contending that the petitioner's group, who lost their case before Court, had attempted to assault the defacto complainant's party and also scolded them in filthy language. It is further submitted that the anticipatory bail petition filed for second accused is pending.
5. Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.V, Trichy and on further condition that the petitioner shall report before the respondent police daily at 10.00 a.m. https://hcservices.ecourts.gov.in/hcservices/
