ORDER

This criminal original petition has been filed seeking a direction to the 1st respondent to comply with order passed by the learned Judicial Magistrate 3, Nagercoil, Kanyakumari District in Cr.MP.No.1927/2025 on 27.11.2025 by conducting a proper enquiry and register an FIR in accordance with law.

2. The learned counsel appearing for the petitioner submitted that the petitioner had filed a petition under Section 175 (3) of BNSS, 2023 before the learned Judicial Magistrate No.III, Nagercoil, Kanyakumari District and the same was allowed. However, there is no progress in the investigation. Hence, this petition came to be filed.

3. The learned Government Advocate appearing for the respondent police, on instructions, submitted that the learned Judicial Magistrate No. III, Nagercoil, Kanyakumari District, has directed the conduct of an enquiry and filing of a report in this regard. Pursuant thereto, the enquiry is being conducted and is still pending. He further assured this Court that the enquiry would be concluded within a week.

In view of the above, the first respondent police is directed to implement the order passed by the learned Judicial Magistrate No.III, Nagercoil, Kanyakumari District in Cr.MP.No.1927/2025 on 27.11.2025, within a period of two weeks from today. This criminal original petition is allowed accordingly.
