O R D E R
The present writ petition has been filed seeking a Mandamus directing the fourth respondent to conduct a fresh tender for the shops Nos. 9, 10, 11, 15, 16, 17, 18, 27, 32, 35, 46, 58, 59, 66, 72, 87, 90, 91, 92, 97 and 98 situated in Municipality Building, Ramanathapuram New bus stand by following Rules 316 of Tamil Nadu Local Bodies Rules 2023, as per the tender dated 17.07.2025.
2. The learned counsel appearing for the writ petitioners submitted that they have not auctioned the shops as per the tender dated 17.07.2025. Therefore, the shops should be brought for fresh auction.
3. Per contra, the learned counsel appearing for the respondent Municipality brought to the notice of this Court that a fresh tender notification was issued on 30.06.2025 for all the shops including the shops 4/8
that are mentioned in the writ petition, and all the 85 shops were auctioned and allotment orders were also issued on 01.08.2025.
4. In paragraph No.9 of the counter, which has been stated that for some of the shops, paper publication was made in Makkalkural and Tamil News daily on 10.12.2025 and on 11.12.2025 for conducting the auction on 18.12.2025. However, the auction could not be conducted on the specified date.
5. The learned counsel appearing for the respondent Municipality submits that they will issue a fresh notification for conducting auction for those shops. Paragraph No.9 of the counter is extracted as follows: " 9. I respectively state that averments made by the petitioner in Para 8, 9 and 10 and of the affidavit is denied false and misleading. The tender notification for the remaining shops were issued vide proceedings dated 18.11.2025 made in Na.Ka.No.934/2025/A2. Due to some reasons, the tender could not be conducted on the date specified. Aggrieved by the same, the third petitioner had filed a writ petition in W.P(MD)No.35343/2025 5/8
challenging the notification. When the writ petition came up for hearing, the Hon'ble High Court was pleased to dispose of the writ petition vide its order dated 09.12.2025 by recording the instruction from the municipality that, it will not proceed with the said notification. Further the Hon'ble Court had directed to issue fresh notification. Subsequently, the Municipality had issued another notification dated 10.12.2025 for 21 shops No.1, 2, 3, 21, 24, 30, 33, 38, 41, 43, 55, 57, 62, 63, 67, 69, 70, 71, 77, 99 &100 and the same was published in the news papers Makkalkural and Tamil News on 10.12.2025 and 11.12.2025 respectively. The said auction cum tender was set to be conducted on 18.12.2025. However, due to administrative difficulties, the same could not be conducted on the specified date".
6. Recording the same, there shall be a direction to the fourth respondent Municipality to issue a fresh notification for the shops mentioned in paragraph No.9 of the counter, by strictly following the Tamil Nadu Transparency in Tenders Act, 1998.

7. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs. Consequently connected Miscellaneous Petitions are closed.
