O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondents to pass orders on the petitioner's application dated 17.10.2025, in accordance with the proceedings of the second respondent, Revenue Divisional Officer, in Na.Ka.A3/10690/06 dated 01.01.2008 and consequently to mutate the patta in the name of Kalaiselvi in respect of the land comprised in Survey Nos.186/4A and 186/4C, situated at Palkulam Village, Kalaiyarkovil Taluk, Sivagangai District, within the time to be fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

The petitioner is the Power Agent of one Kalaiselvi, who executed a Power of Attorney Deed dated 17.10.2025 authorising the petitioner to appear and contest matters relating to the property comprised in Survey No.186/4, Patta No.1511, situated at Palkulam Village, Kalaiyarkovil Taluk, Sivagangai District.

4. The grievance of the petitioner is that the said property originally belonged to Kalaiselvi's father. After his demise, the property devolved upon Kalaiselvi's mother and subsequently upon Kalaiselvi. Meanwhile, one Muthuvel has been illegally attempting to transfer the patta in his name. Therefore, Kalaiselvi submitted a representation dated 30.10.2006 to the second respondent. The second respondent, after conducting a proper enquiry, directed the third respondent vide proceedings dated 01.01.2008 to mutate the patta in the name of the said Kalaiselvi. However, despite several subsequent representations, the patta has not been mutated in her name till date. Therefore, the petitioner submitted a representation dated 17.10.2025, which also did not evoke any response. Therefore, the petitioner has been constrained to file the present Writ Petition.

5. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that the petitioner's representation dated 17.10.2025 would be considered and appropriate orders would be passed by the third respondent within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the third respondent to consider the petitioner's representation dated 17.10.2025 and pass appropriate orders on its merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order. The representation shall be disposed of after conducting an enquiry. The third respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order. In the event of any rival claims, the parties are at liberty to pursue their remedies before the competent Civil Court. There shall be no order as to costs.
