Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the 1st respondent to consider the representation dated 29.01.2021 of the petitioner with reference to the allegations made against the 3rd respondent in the appoint for the post of Enterprise Community Professional in the Mela Athoor Panchayat, Tiruchendur Taluk, Tuticorin District. O R D E R

Heard Mr.S.Siva Thilakar, learned counsel for the petitioner and Mr.P.Kannithevan, learned Additional Government Pleader, appearing for the respondents 1 and 2.

2.The petitioner herein seeks the post of Enterprise Community Professional in the Mela Aathoor Panchayat. The petitioner claims that the third respondent herein is not qualified for the post and yet the respondents have to call her for interview. Even according to the petitioner, the appointments are yet to be took place and with a presumption that the third respondent will be appointed, the present writ petition has been filed.

3.Even assuming the petitioner is qualified for the appointment, such an appointment has to be made only as per the selection process and in accordance with the Rules and Regulations. As such, this Court may not be justified in directing the https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD) No.2602 of 2021 respondents to consider the petitioner's representation for appointing her for the post. Since the petitioner claims that she has already applied for the said post, it is always open to her to undergo the selection process.

4.With the above observations, the writ petition stands closed. No costs. Consequently, connected miscellaneous petition is closed.
