This Criminal Original Petition has been filed to call for the records relating to the proceedings in C.C.No.192 of 2012 on the file of the Fast Track No.II, cum Judicial Magistrate at Nagercoil, Kanyakumari District and quash the same.

2. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondent.

3. When the matter is taken up for hearing today, the learned counsel for the respondent submitted that the complaint has been returned for the reason that the same is to be present before the jurisdictional court, following the decision rendered by the Hon'ble Supreme Court in Crl.A.813 of 2013 dated 01.07.2013 and become infructuous.

4. Recording the said submission, this petition is dismissed as infructuous. Consequently, connected Miscellaneous Petition is closed.
