Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 to A5, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 498(A) of I.P.C., and Section 4 of TNPWH Act, in Crime No.36 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.According to the de-facto complainant, the petitioners demanded more dowry and also harassed her.
3.The learned counsel for the petitioners submitted that as per the order of this Court dated 14.09.2015 the fifth respondent was appeared before the Mediation on three occasions, but the de-facto complainant did not turn up. Therefore, the Mediation could not succeed. 4.The learned Government Advocate (Crl.side) would submit that A1 to A4 were already granted anticipatory bail by this Court on 14.09.2015.
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the fifth petitioner with certain conditions.
6. Accordingly, the fifth petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Manamadurai, Sivagangai District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two https://hcservices.ecourts.gov.in/hcservices/
sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the fifth petitioner shall appear before the respondent police daily at 06.00 p.m., for a period of two weeks and thereafter, as and when required for interrogation. The fifth petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
7. The fifth petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 15/10/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
