ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Mr.A.B.NATARAJAN, Advocate for the petitioner and of Mr.J.S.MURALI, Advocate for R2, and No appearance for R1, the court made the following order:- This petition is filed to condone the delay of 128 days in filing the above said appeal.

2.Heard the learned counsel appearing for the petitioner, Mr.J.S.Murali, learned counsel takes notice for R2. 3.Though notice was served on the respondent No.1 and his name is also printed in the cause list, he not chosen to appear either in person or through counsel.

4.Considering the contention of the learned counsel for the petitioner, the delay of 128 days is condoned on payment of cost of Rs.500/- (Rupees Five Hundred only) to Rojavanam, Homeless & Aged care centre, Melur Road, Uthangudi, Madurai, within a period of two weeks from the date of receipt of a copy of this order, failing which this petition shall stand dismissed automatically without further reference to this Court.
