O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to issue a sub-division separate patta in respect of the property comprised in S.No.247/3, measuring an extent of 2.20.00 hectares, situated at Sethurapatti Village, Srirengam Taluk, Tiruchirappalli District, in the name of the petitioner and his brothers, on the basis of the Settlement Deed bearing Document No.5753/2025 dated 23.09.2025, by considering the petitioner's application in No. 2025/0105/15/440389 dated 07.11.2025, within the time frame fixed by this Court.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. The grievance of the petitioner is that the subject property was jointly purchased by the petitioner's father and one Muthiyan vide a Sale Deed dated 27.01.1987 and a joint patta was issued in their names. Thereafter, the petitioner's father conveyed his share vide a Settlement Deed dated 23.09.2025. The petitioner and his brothers are in joint possession and enjoyment of the share of the petitioner's father. The Page No. 2 of 5

petitioner made an application dated 07.11.2025 seeking sub-division of the property and issuance of separate patta in the names of the petitioner and his brothers and paid the necessary fee. However, no action has been taken on the petitioner's application. Hence, the petitioner has been constrained to file the present Writ Petition.

4. The learned Government Advocate appearing for the respondent, on instructions, would submit that the petitioner's application dated 07.11.2025 would be considered and appropriate orders would be passed by the respondent within a period of sixteen weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the respondent to consider the petitioner's application dated 07.11.2025 and pass appropriate orders on its merits and in accordance with law within a period of sixteen weeks from the date of receipt of a copy of this order. The application shall be disposed of after conducting an enquiry. The respondent is also directed to provide a reasonable opportunity of hearing to the petitioner and any other interested parties who may be affected by such decision, before passing any order.
