Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioners, who are arrayed as A1 and A2, apprehend arrest at the hands of the respondent Police for the alleged offences punishable under Section 4 of Protection of Children from Sexual Offences Act, 2012, on the file of the respondent Police and hence, seek anticipatory bail. 2.According to the de facto complainant, the petitioners / accused have kidnapped the daughter of the de facto complainant on 02.07.2015 for performing marriage with the 1st petitioner / accused. 3.

The learned counsel for the petitioners submitted that both the petitioners are brothers and their father is added as 3rd accused and he was arrested and released on bail by the learned Judicial Magistrate, Tiruenlveli. It is further submitted that it is a case of love affairs and the victim is now under the custody of her grandmother. 4.The learned Government Advocate (Crl.side) appearing for the respondent Police submitted that it is a case of love affairs and the victim has been secured.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate No.III, Tirunelveli, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police daily at 10 am until further orders. https://hcservices.ecourts.gov.in/hcservices/

The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.

6.The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
