Respondent PRAYER: Civil Revision Petitions are filed under Article 227 of the Constitution of India, to call for the records relating to the docket order dated 25-11-2025 in H.M.O.P.No.Unnumbered of 2025 on the file of the learned Subordinate Judge, Rajapalayam, and set aside the same and consequently direct the Court below to number the H.M.O.P. and proceed with the matter on merits.

ORDER

The Civil Revision Petition has been filed challenging the docket order, dated 25.11.2025 in H.M.O.P. No.Unnumbered of 2025 on the file of the learned Subordinate Judge, Rajapalayam. 1/4

2. M/s.Meena, learned counsel appearing for the revision petitioner, submitted that the petitioner had filed an H.M.O.P. before the Sub Court, Rajapalayam. The same was returned on 18.11.2025 stating certain reasons. Thereafter, on 21.11.2025, the petitioner furnished the particulars and details sought for by the Court. Subsequently, on 25.11.2025, the petition was again returned on the ground of maintainability. In response, on 27.11.2025, the petitioner submitted sufficient reasons and complied with the return.

3. However, on 02.12.2025, the petition was again returned stating that the petition has to be filed through e-filing. Thereafter, on 04.12.2025, the petitioner submitted the petition through e-filing. However, the same was not considered by the trial Court. Hence, the present Civil Revision Petition.

4. Considering the submissions made by the learned counsel for the petitioner, the trial Court is directed to hear the petitioner and pass appropriate orders with regard to the maintainability of the petition or the returns made, within a period of one month from the date of receipt of a copy of this order.

5. With the above direction, this Civil Revision Petition is disposed of. No costs.
