PRAYER :- For Bail in Crime No.3 of 2022 on the file of the Respondent police.

ORDER : The Court made the following order :- The petitioner/Sole Accused herein, who was arrested on 03.01.2022 for the alleged offence under Sections 379 of IPC r/w Section 21(4) of Mines and Minerals (Development and Regulation Act) 1957, in Crime No.3 of 2022, on the file of the respondent police, seeks bail.

2.The case of the prosecution is that the petitioner illegally transported five bags of river sand.

3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and she has not committed any offence as alleged by the prosecution.

4.The learned Government Advocate (Crl. Side) for the respondent submitted that the petitioner has illegally transported five bags of river sand. The petitioner is not having any previous case in similar nature.

5.Considering the period of incarceration and the petitioner is not having any previous case in similar nature, this Court is inclined to grant bail to the petitioner with certain conditions. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.1764 of 2022 6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Trichy and on further condition that the petitioner shall report before the respondent police once in fifteen days at 10.30 a.m. until further orders. sd/- 31/01/2022 / TRUE COPY / 31/01/2022 Sub-Assistant Registrar (C.S.)
