ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 138 of the Negotiable Instruments Act on the file of the respondent police, seeks anticipatory bail.
2. The petitioner is charged for an offence under Section 138 of the Negotiable Instruments Act and it is stated that Non-Bailable Warrant has been issued.
3. An offence under Section 138 of the Negotiable Instruments Act is a bailable offence and therefore, the petition for anticipatory bail is not maintainable. Hence, the petitioner is directed to appear before the learned Judicial Magistrate No.I (Fast Tract Court No.I), Madurai for the purpose of recalling the warrant issued against him and the concerned Magistrate shall pass orders on the same day.
4. With the above direction, this Criminal Original Petition is closed.
