ORDER

This Criminal Original Petition is filed to direct the 1 and 2nd Respondents to issue necessary Police Protection to the life and limp of the Petitioner and his Family, on the basis of the complaint of the Petitioner, dated 22.11.2025 within a time frame as fixed by this Court.

2. Learned counsel for the petitioner submitted that the petitioner has already given a complaint to the second respondent police but the said complaint has been left unattended. He further submitted that when the petitioner started construction of his house with all necessary permission from the concerned authorities, the third respondent who is a local politician has unnecessarily obstructed the same and hence he has given a complaint to the second respondent seeking police protection.

3. Learned Government Advocate appearing for the respondents 1 and 2 categorically contended that the petitioner is residing in Kerala for his avocation. The third respondent is a politician. The dispute is with regard to the boundary of the properties between the petitioner and the third respondent. In this regard already an inquiry has been conducted 2/5

and the same is duly closed, advising them to approach the concerned civil Court.

4. However, the learned counsel for the petitioner categorically contended that the threat to his life continues.

Though it is claimed by the learned Government Advocate that the petitioner is residing at Kerala, the petitioner submitted that construction is going on and the petitioner's father who is a senior citizen is residing in the property, is facing serious threats in this regard. If at all the petitioner is so keen in getting a protection for his father or either to himself, the petitioner should borne the charges in terms of G.O.Ms.No. 139 Home (Pol.VIII) Department dated 04.03.2019. On such payment, the respondent police can extend protection whatever claimed by the petitioner, regarding his life and limb alone. It is made clear that as far as the property dispute the parties are directed to approach the concerned Civil Court.

6. With the above directions, this Criminal Original Petition is allowed.
