Respondents Prayer: Petition - filed under Section 482 of the Criminal Procedure Code, to direct the respondents 1 to 3 to provide adequate Police protection to the life and limb of the petitioner and her trust namely Nivethitha's Trust's members as well as petitioner's Trust's properties, situating in Survey No.693, situating in Ayyan Thoppu, Thangatchi Madam, Rameswaram Taluk, Ramanathapuram District, based on the petitioner's representation dated 16.03.2019 within the time limit that may be stipulated by this Court.

ORDER

This petition is filed to direct the respondents 1 to 3 to provide adequate Police protection to the life and limb of the petitioner and her trust members.

2. Heard the learned counsel appearing for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 to 3.

3. The present petition is filed by a certain Nivethitha Trust, whose main object is to enhance women empowerment. The petitioner and their trust's members requested the Government to provide land for their Trust. They have been allotted some land. The learned counsel appearing for the petitioner submitted that the property is fenced on all sides. But suddenly the respondents 4 to 11 started to interfere with their possession and have damaged the fence. A complaint has been preferred for preserving the life, limb and property of the petitioner and the trust property as the case may be.

The learned Additional Public Prosecutor submitted that a complaint preferred by the petitioner is pending enquiry in C.S.R.No.33 of 2019 and another complaint preferred by one of the member of the Nivethitha Trust is now pending enquiry in C.S.R.No.39 of 2019. He also added that the matter has been referred to the peace committee headed by the Tahsildar.

5. Be that as it may, inasmuch as the petitioner faces threat to the person and also the property of the Trust which is originally belonged to the Government, the petitioner is now directed to prefer a fresh representation / complaint to the third respondent Police, receiving which, the third respondent shall cause necessary enquiry and take necessary decision to protect the life and liberty of the petitioner.

6. With the above direction, the Criminal Original Petition stands disposed of.
