J U D G M E N T

[Judgment of the Court was made by DR.G.JAYACHANDRAN, J.] In view of the order, dated 09.02.2026, passed by the Full Bench of this Court in W.P.(MD) No.26547 of 2025 in the case of Jawahar Rajan vs. The Regional Passport Officer, concerning the issuance of fresh / renewal of passport for the persons against whom criminal cases are pending before the Court, we find that the order of the learned Single Judge in the case on hand requires interference of this Court.

2. Accordingly, this writ appeal is allowed and the order dated 02.07.2025, passed in W.P.(MD) No.17888 of 2025, is set aside. The first respondent, against whom a criminal case is pending and charges are framed, has to seek permission from the Criminal Court and proceed further with the matter. No costs.
