ORDER : This petition coming on for orders upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR. T.SELVAKUMARAN, Advocate for the petitioner and of MR.A.ELANGO, Advocate for R2, the court made the following order:- The petition is filed to condone the delay of 326 days in https://hcservices.ecourts.gov.in/hcservices/
filing the above appeal.
2. Though notice was served on the first respondent and his name is printed in the cause list and there is no representation for the first respondent either in person of through counsel.
3. Mr.A.Elango, learned counsel takes notice for the second respondent and he has no objection for allowing the petition.
4. Recording no objection made by the learned counsel for the second respondent and being satisfied wit the reasons stated in the supporting affidavit filed for condonation, the delay of 326 days is condoned and the petition is ordered on payment of cost of Rs.500/- (Rupees Five hundred only) to the Rojavanam Homeless & Aged Care Centre, Melur Road, Uthangudi, Madurai, within a period of one week from the date of receipt of a copy of this order, failing which, this petition shall stand dismissed automatically, without further reference to this court.
