: 2nd Respondents/ Defacto Complainant PRAYER : Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for the records pertaining to the First Information Report in Crime No.82 of 2018, dated 01.06.2018 alleged offence under Section 151 of Cr.P.C and Section 7(1)(a) of Criminal Law Amendment Act, 2005 on the file of the firs respondent police and quash the same as illegal.

ORDER

This petition has been filed to quash the proceedings in Crime No.82 of 2018 dated 01.06.2018.

2. Heard the learned counsel for the petitioners and the learned Government Advocate (Crl.Side) for the respondents. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Government Advocate (Crl.side) appearing for the respondents submitted that investigation is completed and final report is laid on 19.06.2018 and it is not yet taken on file.

4. The statement made by the learned Government Advocate (Crl.Side) is recorded. Inasmuch as the final report has been filed in the complaint given by the second respondent as well as the petitioners, nothing survives for further adjudication in the present petition. However, these petitioners are at liberty to challenge the final report, if there are materials for challenging the same, in accordance with law.

5. The Chief Judicial Magistrate, Thoothukudi District, is now directed to look into the matter as to why the final report laid on 19.06.2018 is not yet taken on file.
