PRAYER: This Criminal Original Petition filed under Section 482 of Cr.P.C, praying, to call for the records relating to the complaint in C.C.No.689 of 2021 on the file of the learned Judicial Magistrate No.I, Dindigul and quash the same.

ORDER : This Petition coming on for orders on this day upon the perusing the petition and the affidavit filed in support thereof and earlier order of this court dated 09.02.2022 and the letter submitted by the Judicial Magistrate No.I, Dindigul vide in D.No. 1712 of 2022, dated 18.11.2022, for requesting for further extension of time to dispose the C.C.No.689 of 2021 pending on its file, this Court made the following Order:

Today, this case is listed under the caption for "Extension of Time for Lower Court".

2. It is evident from the records that this Court in Crl.O.P. (MD)No.2499 of 2022 vide order dated 09.02.2022 has directed the trial Court to refer the complaint before the Lok Adalat for amicable settlement and further directed the Lok Adalat to complete the proceedings within a period of four weeks from the date of reference and if the parties failed to settle the matter before the Lok Adalat, the trial Court was directed to proceed further with the trial and complete the same within a period of six months thereafter.

3. The learned Judicial Magistrate No.I, Dindigul, has submitted a requisition dated 18.11.2022 stating that since the https://www.mhc.tn.gov.in/judis 1/2

CRL OP(MD) No.2499 of 2022 matter was not settled before the Lok Adalat, the bundle was returned to the Court on 06.05.2022, that Bailable Warrant was issued against the accused twice and the same was recalled and that the accused was questioned under Section 313(1)(b) Cr.P.C. and the case stands posted for defence evidence.
