ORDER : The Court Made the following order :- The petitioner/sole accused, who was arrested and remanded to judicial custody on 23.12.2014 for the alleged offences punishable under Sections 8(c) r/w 20(b) (ii) (c) of NDPS Act, 1985 in Crime No.60 of 2014 on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that the petitioner was in possession of 91.5 Kgs of ganja.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Government Advocate(Crl. Side) on instructions submitted that this is the fourth bail petition filed by the petitioner and in this case, investigation was completed and charge sheet is filed and the case is posted on 16.11.2015 for examination of Investigation Officer. He further submitted that the petitioner is having two previous cases and he is involved in a case of possession of commercial quantity of ganja and therefore, as per Section 37 of NDPS Act, there is a bar for granting bail to the accused.

5.Considering the gravity of offence and also considering the fact that the petitioner is having two previous cases, this Court is not inclined to grant bail to the petitioner. Hence, this Criminal Original Petition is dismissed.
