Writ Petitions filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, directing the respondent to renew petitioner's Passport based on his application in File No. TR2066274444324 dated 19.02.2024 and consequently, issue renewed passport to the petitioner within the time limit that may be stipulated by this Hon'ble Court.

O R D E R

This writ petition has been filed for issuance of a writ of mandamus, directing the first respondent to renew the passport of the petitioner in application No.TR2066274444324, dated 19.02.2024, within the time stipulated by this Court.

When the matter was taken up for hearing, the learned Deputy Solicitor General of India, appearing on behalf of the first respondent, submitted that the application is under process and awaiting the police verification report. Once the police verification report is received, it will be considered and based on that, the petitioner's passport will be processed.

3. The learned counsel for the petitioner submitted that the respondent police have not issued the police verification report for more than six months which seriously affects the petitioner's right to travel.

4. Heard the learned counsels on either side and carefully perused the entire materials available on record.

Considering the submissions made by both parties, this Court is of the considered view that the petitioner's application for issuance of passport has been pending for an inordinate period of time due to the non-receipt of the police verification report from the third respondent. Therefore, there shall be a direction to the third respondent to complete the process of police verification in accordance with law and issue the verification report within a period of one month from the date of receipt of a copy of this order. Upon receipt of the police verification report, the first respondent shall consider the petitioner's passport application and take a decision on merits and in accordance with law, preferably within four weeks thereafter.
