PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a writ of Certiorarified Mandamus, to call for the records relating to the 2nd respondent proceedings in charge Memo No.P2/11886/2017-2, dated 14.02.2018 and quash the same and consequently direct the Respondents to permit the petitioner to join the promotion post allotted in 2023 to the petitioner. ORDER

The instant writ petition has been filed by a Forest Guard, challenging a charge memo issued by the second respondent on 14.02.2018 under Rule 17(b) of the Tamil Nadu Civil Services(Discipline and Appeal) Rules, 1955. 2.According to the learned Counsel appearing for the writ petitioner, the District Forest Officer of Tirunelveli Range was appointed as the Enquiry Officer and he has submitted his report in the year 2019 itself. However, so far final orders have not been passed by the disciplinary authority. Hence, he has challenged the charge memo.

3.I have carefully perused the charge memo and this Court is of the considered opinion that no grounds have been raised by the writ petitioner for quashing the charge memo. However, according to the learned Special Government Pleader appearing for the respondents, the first respondent is the competent authority to pass final orders based upon enquiry report submitted by the District Forest Officer, Tirunelveli.

4.Considering the fact that the enquiry was completed in the year 2019 and so far, no final orders have been passed, this Court is inclined to direct the 2/4

first respondent herein to pass final orders within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above said observations, this writ petition stands disposed of. No costs.
