ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 2, apprehend arrest at the hands of the respondent police for the alleged offence punishable under Section 174 Cr.P.C., and subsequently altered to 306 of I.P.C. Crime No.342 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2. The prosecution case is that the first petitioner and the deceased were working in Kevin Engineering Company, Coimbatore and they fell in love with each other and the first petitioner promised the deceased to marry her and subsequently, at the instigation of the second petitioner, he refused to marry her. Hence, the deceased committed suicide.
3. The case of petitioners is the deceased insisted the first petitioner to marry her immediately. He informed her to wait for completion of construction of his house. The deceased committed suicide and they are no way connected with the alleged occurrence.
4. Heard the learned Government Advocate (Crl.side).
5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be https://hcservices.ecourts.gov.in/hcservices/
released on bail in the event of their arrest or on their appearance before the learned Judicial Magistrate No.I, Bodinayakkanur and on their executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and the petitioners shall appear before the respondent police once in a week i.e., on every Sunday at 10.00 a.m. until further orders. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy is made ready, failing which, the petition for anticipatory bail stands dismissed.
