ORDER

This writ petition has been filed challenging the refusal check slip issued by the second respondent dated 08.04.2022 thereby refused to register the general power of attorney dated 17.12.2022 executed in favour of the petitioner on the ground that already the sale deed of the petitioner's principal was declared as null and void.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

On perusal of the records revealed that one Rani filed a suit as against the petitioner's principal and declared the sale deed dated 28.10.2010 registered vide document No.5639 of 2010 as null and void. The petitioner's principal, on the strength of the sale deed, executed the power of attorney in favour of the petitioner. Therefore, the registering authority rightly refused to register the power of attorney.

4. In view of the above, this Court finds no infirmity or illegality in order passed second respondent and it is devoid of merits and it is liable to be dismissed.

5. Accordingly, the writ petition is dismissed. No costs. 30.01.2025 Index : Yes / No NCC : Yes / No am 3/4
