ORDER
Challenging the judgment dated 06.12.2025 made in C.M.P.No. 24 of 2025 in C.M.P.No.46 of 2024 in MC No.34 of 2019 on the file of the learned Family Court, Thanjavur, this Criminal Revision case is filed.
2. The petitioner and the respondent are the husband and wife. The wife filed a maintenance case in M.C.No.34 of 2019 before the learned Family Court, Thanjavur. After hearing both parties, the learned Family Court, by an order dated 01.04.2021, directed the husband to pay a monthly maintenance of Rs.50,000/- to the wife from the date of filing of the maintenance case. The said decision was arrived at on the basis of the evidence of PW-1, recording that the husband has sufficient needs and sources of income to maintain him and his legally wedded wife, who is the respondent herein.
3. Since the husband failed to pay the maintenance as ordered by the learned Trial Court, the wife filed C.M.P.No.46 of 2024 in M.C.No.34 of 2019 seeking attachment of the petitioner's property. Seeking to recall the said attachment order, the husband filed 2/6
C.M.P.No.24 of 2025 in C.M.P.No.46 of 2024 in M.C.No.34 of 2019. After hearing both parties, by an order dated 06.12.2025, the learned Trial Court passed the impugned order, recording the fact that there exists against a total arrear amount of Rs.34,00,000/- to be paid by the husband, and directing the husband to pay an amount of Rs. 10,00,000/- to the respondent wife on or before 06.01.2026 for removal of attachment and posted the case further on 07.01.2026. Challenging the same, this Criminal Revision case is filed.
4. The learned counsel for the petitioner submitted that the said condition is unreasonable and sought for indulgence of this Court seeking to set aside the impugned order. He has also pointed out that the wife proceeded as against the husband at the instigation of her elder son, namely, Sethu, who is an advocate, and required this Court to direct the parties to appear before this Court and facilitate the husband to meet his wife.
5. When the matter was taken up for hearing, it was brought to the knowledge of this Court that the husband and the wife appeared before this Court and the wife submitted that the husband had 3/6
married another woman during the subsistence of the first marriage with her, and he has another son through his second marriage. He had never ever maintained her and her son. She is continuously living with the support of her elder son, who is an advocate. It is also made clear that she is suffering with day to day expenses including medical expenses.
6. In view of the same, I do not find any infirmity in the impugned order.
7. Accordingly, this Criminal Revision case is dismissed.
8. The petitioner is directed to pay an amount of Rs. 10,00,000/- to the respondent wife in view of the compliance of the order dated 06.12.2025 passed by the learned Trial Court on or before 20.04.2026.
