Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus, calling for the records relating to the impugned inter-se-seniority list in Pdl.RC.No.182/2024/N1 dated 27.12.2024 issued by the first respondent and quash the same and consequently direct the first respondent to issue inter-se-seniority list as per Rule 9 of TamilNadu Treasuries and Accounts Subordinates Services Special Rules and Rule 40(2) of TamilNadu Government Servants (Conditions of Service) Act, 2016.

The instant writ petition has been filed by a promotee Accountant working in the Treasury Accounts Department, challenging the impugned inter-se seniority list published by the first respondent on 27.12.2024. 2/6

2. A perusal of the impugned inter-se seniority list discloses that it is a tentative seniority list and objections have been called for from the aggrieved parties and the same have to be submitted on or before 31.01.2025.

3. The learned Additional Advocate General appearing for the respondents 1 to 3 pointed out that it is only a tentative seniority list and therefore, the objections, if any given by the petitioners would be considered in accordance with the Government Rules.

4. However, the learned Counsel appearing for the petitioner had relied upon Para.3 of the impugned order and contended that in case, if any objection is raised touching upon the sections or rules that were followed for preparing the impugned inter-se seniority list is objected, such an objection would not be considered. Therefore, they are constrained to file this present writ petition.

5. The learned Additional Advocate General appearing for the respondents 1 to 3 had clarified that para.3 of the impugned seniority list would only mean that any objections which are not in consonance with rules 3/6

would be considered. Therefore, it is clear that the petitioner would always be at liberty to raise any objection relating to the inter-se seniority or the Section or the rule that was followed by the authorities in preparing the inter-se seniority list dated 27.12.2024.

6. With the above said clarifications, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petitions are closed. 29.01.2025 NCC : Yes/No (1/2) Index : Yes / No Internet : Yes / No gvn 4/6
