petitioner to admit the students in Electrical and Fitter grade in spare capacity of Polytechnic vide the inspection conducted on 15.05.2023 and 16.05.2023 by the Inspection Committee and further to include the petitioner's ITI name in the portal of Government online counselling list for the academic year of 2024-2025 by granting approval vide proceedings R.C. No.27746/CT4/2021 dated 03.05.2023. ORDER

Heard the learned counsel appearing for the writ petitioner, the learned Deputy Solicitor General of India appearing for the first respondent and the learned Additional Government Pleader appearing for the respondents 2 and 3.

2.The writ petitioner is running a polytechnic college. The petitioner wants to admit students in Electrical and Fitter grade also. This would be possible only if the petitioner's ITI name is included in the 2/6

portal of Government Online Counselling list for the academic year. Since the process was getting delayed even after the submission of representations, the present writ petition came to be filed. 3.The respondents 2 and 3 have filed counter affidavit. Paragraphs 7 and 8 of the counter affidavit filed by the third respondent read as follows:

"7. It is submitted that, in the G.O(Ms)No.59, Labour Welfare and Skill Development (S1) Department, dated 01.06.2022, State Skill Development and Entrepreneurship Committee (SSDEC) was formed for scaling up Skill Development activities such Admission, Examination, Affiliation & De-affiliation of ITIs, Skill India competitions on a fast track. As per Director General of Training, New Delhi instruction, the Joint Inspection report was placed before the State Skill Development and Entrepreneurship Committee (SSDEC) for recommendation. The State Skill Development and Entrepreneurship Committee (SSDEC) in its meeting held on 14.08.2023 has recommended and the same was forwarded to Director General of Training, New Delhi to place it in the Standing Committee on Accreditation and Affiliation (SCAA) for getting approval. In the letter No.DGT-Aff011/4/2023-O/o DIR [E-63172] dated 12.01.2024 has raised quarry. Based on the quarry 3/6

details have been collected from the petitioner institute and after verification reply for the quarry has been sent to Director General of Training, New Delhi vide 2nd respondent letter no.6817/CT4/2021, dated 02.02.2024. 8.It is submitted that in Director General of Training, New Delhi letter No.DGT-Aff/2/2024-O/o DIR [E-65321], dated 03.05.2024 has informed that, activation of trade units of Petitioner Institute (Jeya Private Industrial Training Institute, Swayerpuram) has been recommended by Standing Committee on Accreditation and Affiliation (SCAA) and implementation orders agenda item wise will be issued in due course of time."

In the typed set of papers, communication from the first respondent as well as the second respondent has been enclosed. It is seen therefrom that the reports submitted were verified and found to be satisfactory as far as the petitioner is concerned. In these circumstances, any further delay on the first respondent will definitely affect the petitioner. 4.I therefore direct the first respondent to include the petitioner's ITI name in the portal of Government Online Counselling list for the academic year 2024-25 immediately and without any delay. The petitioner is granted liberty to communicate the copy of this order to the 4/6

first respondent and it shall be the duty of the first respondent to comply with the same.

5.This writ petition is allowed accordingly. There shall be no order as to costs.
