ORDER

The present Writ Petition has been filed for the issuance of a Writ of Certiorarified Mandamus, to quash the impugned order dated 29.10.2025 and consequentially, direct the first respondent to issue modified patta to the petitioner as per his sale deed dated 27.10.2022.

2. The petitioner purchased the land in Survey No. 359/1F through a sale deed dated 27.10.2022, registered as Document No. 4574 of 2022, to an extent of 17.75 cents. The contention of the petitioner is that patta has been issued for a lesser extent, whereas he is entitled to patta in accordance with the sale deed dated 27.10.2022. However, the respondents refused to grant patta for the said extent, stating that the petitioner is not in possession of the property for the remaining portion. The petitioner further contended that the revenue authorities are not the competent authority to decide the extent of the property. Therefore, the petitioner is seeking to issue patta to the extent of 17 3⁄4 cents.

3. In view of the above, the respondents are directed to issue patta based on the sale deed dated 27.10.2022 for an extent of 17.75 cents. If any person is in occupation of the balance disputed area, the petitioner is at liberty to approach the competent Civil Court to evict them from the said place. The petitioner cannot 2/4

take the law into their own hands and evict any person. Hence, the impugned order is quashed.

4. With the above observations, this Writ Petition is allowed. There shall be no order as to costs.
