This petition has been filed seeking a direction to the 2nd respondent not to harass the petitioner on the basis of his complaint dated 28.03.2019.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents 1 & 2. This Court has paid its anxious consideration to the submissions made on either side.
3. The petitioner complains harassment at the hands of the second respondent presumably on the complaint preferred by the third respondent. The learned counsel for the petitioner submitted that there is some matrimonial difference between the petitioner and the third respondent's daughter with whom betrothal ceremony has been taken place.
4. The learned Additional Public Prosecutor appearing for the respondents 1 and 2 submitted that the third respondent's daughter is a minor and the complaint was preferred by the Social Welfare Officer based on a tip-off about giving a minor girl in marriage and that is being enquired into. He would submit that the respondents 1 and 2 have not harassed the petitioner and they have https://hcservices.ecourts.gov.in/hcservices/
no intention to harass the petitioner.
5.The learned counsel for the petitioner submitted that only engagement ceremony is concluded and marriage is not yet concluded. 6.In such circumstance, if at all second respondent required the presence of the petitioner for interrogation or enquiry, the same shall be done only on issuing summons mentioning specific date and time for enquiry and during enquiry, there shall not be harassment.
7.With the above direction, this Criminal Original Petition is disposed of.
