Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.1 in Crime No.17 of 2015, apprehend arrest at the hands of the respondent police for an alleged offence punishable under Sections 498(A), 495, 406, 506(i) of IPC and Section 4 of Dowry Prohibition Act, on the file of the respondent police, seek anticipatory bail.
2. According to the de facto complainant, her earlier marriage was dissolved in the year 2012. However, the accused suppressing his earlier marriage by producing false certificate married the de facto complainant in the year 2014 and thereafter, demanded 25 sovereigns of jewels and also house hold articles, when it was questioned, the accused have threatened the de facto complainant with dire consequences.
3. The learned counsel for the petitioners submitted that the petitioner is an innocent person and he has been falsely implicated in this case.
4. The learned counsel Government Advocate (Crl. Side) submitted that in this case, co-accused were granted anticipatory bail by this Court in Crl.O.P(MD)No.18192 of 2015, vide order dated 21.09.2015.
5. Considering the facts and circumstances of the case and co accused was granted bail, this Court is inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Sivakasi, and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent https://hcservices.ecourts.gov.in/hcservices/
Police as and when required for interrogation. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6.
