O R D E R

[Order of the Court was made by G.K.ILANTHIRAIYAN, J.] Seeking to suspend the sentence imposed on the petitioner by the learned Additional District and Sessions Judge Dindigul , vide Judgment dated 25.09.2023 in Spl.S.C.No.122 of 2019, the present Criminal Miscellaneous Petition has been filed.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner has failed to make out a prima facie case for grant of suspension of sentence , hence we are of the opinion that it is not a fit case for grant of suspension of sentence to the petitioner.

4. Accordingly this Criminal Miscellaneous Petition stands dismissed.

5. The learned counsel appearing for the petitioner seeks interim suspension for the petitioner stating that the petitioner's father died on 24.12.2025 and 40th day death ceremony has to performed. Though this Court is not inclined to suspend the sentence, the petitioner is at liberty to submit a representation before the Superintendent of Prison, Trichy seeking emergency leave pending appeal. On receipt of such representation either by the petitioner or any of the family members of the petitioner, the Superintendent of Prison, Trichy is directed to dispose the same inaccordance with law forthwith [G.K.I., J.] & [R.P., J.] 28.01.2026 NCC : Yes / No Index : Yes / No aav
