Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Declaration to declare the non selection of the petitioner by the proceeding of the Respondent No.2 dated 05.12.2012 as illegal and null and void and consequently direct the Respondents to appoint the peitioner in the post of B.T. Assistant (Graduate Teachers) Maths with consequential benefits .

In the light of the above facts and circumstances of the case, this Civil Miscellaneous Petition is closed. However, it is made clear that the said appointment is subject to the result of the Writ appeal and the respondent/Writ petitioner cannot claim equity by virtue of the said accommodation.
