Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as A4, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Sections 9M and 10 Protection of Children from Sexual Offences Act, 2012 r/w 294(b) and 506(i) of I.P.C., in Crime No.111 of 2015 on the file of the respondent police and hence, seeks anticipatory bail.

2.The case of the prosecution is that on 10.08.2015 at 07.00 p.m., when the daughter of the de-facto complainant was alone in her house, the first accused said to have misbehaved with her and thereafter when it was questioned by the de-facto complainant, the accused have threatened her with dire consequences. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case.

4.The learned Government Advocate (Crl.side) would submit that A2 and A3 were already arrested and released on bail.

5. Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions.

6. Accordingly, the petitioners are ordered to be released on bail in the event of arrest or on his appearance before the learned

Judicial Magistrate, Nilakottai, Dindigul District and on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall reside at Trichy and appear before the Fort Police Station daily twice ie., at 10.00 a.m., and 05.00 p.,m., until further orders. The petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. Scrupulously.

7. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed.
